If
you believe someone is violating HIPAA regulations you can report
infractions to the Department of Health & Human Services Office
of
Civil Rights (OCR). Complaints to the OCR must be submitted
in
writing or electronically. OCR has provided forms, or you can submit in
your own format. If you choose to submit in your own format,
it
must contain the following information:
·Your
full name, contact information, including E-mail;
· If you are
submitting for someone else, it must also contain their full name,
contact information, including E-mail;
· The full name,
contact information, and a contact person of the company or person you
believe violated privacy rules;
· A brief description
of what, when and how the violation happened; and
· Any other relevant
information that would help the investigation.
Complaints
should be sent to the regional office responsible for your
state.

As
a reminder, the sharing of protected health information (PHI) can occur
between treating entities, such as your office and a referring
physician without violating HIPAA rules.
Support
for Requesting Documentation from Physicians
In a recent letter posted on the Program Safeguard
Contractor’s (PSC) web site for Jurisdiction A/B, Dr. Paul
Hughes
reminded physicians of their need to cooperate in supplying necessary
information to DMEPOS suppliers in support of their patient’s
treatment needs. Quoting a section of the Social Security Act, Dr.
Hughes tells physicians it is their legally mandated responsibility to
provide information from a patient’s medical record when it
is
requested in order for DMEPOS suppliers to bill for services the
physician has ordered. Dr. Hughes goes on to say that not
supplying the information could cause financial hardship for the
patient if the patient has to pay for the item out of pocket.
Even if you are not in Jurisdiction A/B, this information is
still
valid. This letter can be used to support information requests to
physicians whose patients’ you have treated. You can obtain a
copy of the letter at their

AOPA’s Board of
Directors initiated
strategic planning during their July 2007 meeting and a critical
element of this plan is a soon to be released member survey. This
survey seeks basic information on how members see the future of their
businesses, documents changing patterns in reimbursements, and solicits
input on practice management issues and utilization of AOPA
services.
Several members have volunteered to test the questionnaire
and
plans are for a full release by E-mail to members in
December.
Results will be at least partially tabulated by the Jan. 21 Board
meeting at
AOPA headquarters in
Alexandria and will
begin to guide some of the Board’s decision-making over the
next
several months regarding how
AOPA can
better serve members as changes occur in the O&P field.

Watch
for it because the Business Optimization Analysis Tool will open to
testing right after the first of the year. Those firms who
assisted in testing this management tool in an earlier stage of
development will be among those invited to enjoy a complimentary six

(OPC) study this year will also receive a six month trial as a thank

AOPA members should check their current

The “Guidelines on Billing Different Venues
& Should I
Participate with Medicare?” audio seminar is now available

The final Medicare audio seminar of 2007 will be held on
Dec.
20. The topic is “New Codes for 2008 &
Preparing for
2008: A Competitive Bidding Update.” Cost is $99 for
members
and $199 for non-members per phone line. There is no limit on
the
number of participants who may listen to the call.

National Assembly Planning Already
Under Way
The 2008
Assembly Advisory Committee
will meet in Chicago, Dec. 11-12, to start mapping out plans for next
year’s September 10-13, 2008 Assembly. Russ
Hornfisher of
Becker Orthopedic Appliance Company chairs the Advisory Committee and
will lead the tour of the Hyatt Regency Chicago facilities, chair the
working lunch and oversee the process of planning the biggest and the
best National Assembly event ever.
Expect some
changes reflecting the
evaluations completed by members at the 2007 National Assembly
including high-level speakers and programs that spark that
“wow” quality. Contributing to the
success of the
event is its outstanding location in the heart of Chicago’s
booming commercial area. It’s a short walk to best
restaurants, tourist attractions and the Miracle Mile.
